POLLING AGENT

Each candidate can appoint as polling agent and two substitutes in each polling station of the constituency in which he is contesting.

The polling agent has the following duties :
Make sure that the control unit of the voting machine is sealed properly; make sure that the presiding officer has tied and sealed all documents concerning voting; the polling agent should not try to influence the voters. Violation of rule brings a fine of Rs. 250/-

 

 

 

 

 


CHALLENGE

If a person comes to vote in another person's identity, then the polling agent can 'challenge' by paying Rs. 2/- . The presiding officer must make an enquiry immediately. After the enquiry , if the officer finds that the agent is wrong , the 2 rupees will go to the Government. Otherwise the money is given back. The presiding officer has the authority to prevent such voting and arrest the person who tries to do it.

 

 

 

 

 



COUNTING AGENT

The candidate can appoint a counting agent for each table. An agent can be appointed to observe the counting at the returning officer's table. The candidate and the election agent have the right to enter the counting hall . Bringing voters in the vehicles belonging to the candidate or vehicles sent by the candidate is punishable.

 

 

 

 

 

 



TENDERED VOTE

If a situation of a mistaken identity occurs, i.e., one person casts his vote and then another person claims that voting right, then the presiding officer can make the second person cast a 'tendered vote'. For this, a ballot paper on which 'tendered vote' is written on the other side is used. After casting the vote, the ballot paper is returned to the presiding officer. If the election result of that particular constituency is challenged in the court, the court can consider the tendered vote.
